Entertainment Lockers, Inc. d/b/a Venue Vault

These General Terms and Conditions (“Terms”) apply to the use of all services offered by Entertainment Lockers, Inc. d/b/a Venue Vault (the “Operator”), and to all agreements made with the Operator concerning personal items, cellular phones, clothing, bags, money, and/or valuables (the “Articles”) placed in the Operator’s locker equipment (the “Equipment”). The Operator offers two distinct products:
Mobile Lockers: mobile locker units deployed on a temporary basis at outdoor events (each, an “Event”), secured by a physical padlock and combination supplied by the Operator; and
Smart Lockers: permanently installed lockers at indoor entertainment venues (each, a “Venue”, and together with an Event, a “Location”), accessed by scanning a QR code posted on the locker using the User’s own smart device, which opens the Operator’s web-based application (“web-app”) in the device’s browser.
Except where these Terms expressly distinguish between the two products, all provisions apply equally to both. References to “User” or “you” mean any person using either product.
1. Formation of Agreement
An agreement or promise is legally valid and enforceable by the User once, and only once, the User has: (a) reserved and/or paid for a locker rental in advance through the Operator’s website (a “Pre-Sale Booking”); or (b) purchased and activated a locker rental in person at an Event or Venue, at the on-site locker location, kiosk, or with an Operator attendant (an “On-Site Booking”). Selecting “I Agree,” completing payment, accepting a supplied padlock and combination, or scanning a QR code to open a Smart Locker constitutes acceptance of these Terms, regardless of booking channel.
2. User Obligations
The User agrees to observe all posted, printed, electronic, and web-app instructions concerning use of the Equipment. For Temporary Mobile Lockers, the User is responsible for the proper use and safekeeping of any padlock and combination supplied by the Operator. For Smart Lockers, the User is responsible for safeguarding any QR code, receipt, or web-app session issued in connection with a rental. The User is responsible for any use of the Equipment made using a supplied combination, QR code, or session, whether or not authorized by the User.
3. Service Types and Rental Periods
3.1 Smart Lockers (Indoor, Permanent)
Smart Lockers at a Venue are rented for the period selected by the User at the time of booking (e.g., single-visit, daily, multi-day, or season/event-pass rental, as offered at the applicable Venue). Smart Locker rentals do not automatically renew unless the User selects a recurring or season-long rental option at booking.
3.2 Mobile Lockers (Outdoor, Event-Based)
Mobile Lockers are deployed solely for the duration of a specific Event, as posted at the Event or stated at the time of booking. Rentals may be purchased in advance as a Pre-Sale Booking on the Operator’s website or on-site as an On-Site Booking at the Event locker location, subject to availability; on-site availability is not guaranteed, particularly for lockers not reserved in advance. A Temporary Mobile Locker rental does not carry over to any other Event or to any Venue, and confers no right to the same locker, location, or Equipment at a future Event.
A locker not vacated by the end of the applicable rental period, at either a Venue or an Event, will be treated as provided in Section 10 (Unclaimed Articles) below.
4. Refunds
No refunds will be offered or given once a locker rental has been booked and paid for — whether through a Pre-Sale Booking or an On-Site Booking, and whether the locker is used or not — except where required by applicable law or expressly stated in a separate Operator or Venue/Event promotion.
5. Prohibited Articles
Articles may not be kept or stored in the Equipment that might constitute a risk or nuisance to the Operator, other users, the Location, or the general public, including but not limited to illegal items, illegal substances, explosives, firearms or other weapons, hazardous chemicals, and perishable goods. The Operator is entitled to require that Articles be shown to Location or Operator personnel before being placed in a locker. Articles that, in the Operator’s reasonable opinion, are hazardous, illegal, or a nuisance may be refused, and where already placed in a locker, may be removed, isolated, and/or turned over to Location security or law enforcement at the User’s expense, without the User being entitled to enforce any claim to the Articles at any time thereafter.
6. Locker Access
At any time, the Operator is entitled to: (a) verify the identity of the User by means of a government-issued form of identification (and to make a copy thereof), booking confirmation, receipt, or payment method used at booking; (b) release Articles only at the end of the applicable rental period or upon the User’s proof of entitlement; and (c) apply any administration or service charges disclosed at the time of booking. Lockers will not be released based on a verbal description of the Articles alone.
6.1 Mobile Lockers — Combination Lock Access
Access to a Mobile Locker is provided by a physical padlock and combination supplied by the Operator at the time of booking. The User is solely responsible for the supplied padlock and combination for the duration of the rental. This product does not involve a QR code, web-app, or other electronic access system.
6.2 Smart Lockers — QR Code and Web-App Access
Access to a Smart Locker is provided by scanning a QR code posted on or near the locker using the User’s own smart device (such as a smartphone). Scanning the code opens the Operator’s web-app directly in the device’s mobile browser; no native app download, app-store account, or persistent User account is required. The Operator may verify identity for a Smart Locker rental by means of the User’s web-app session, booking confirmation, receipt, or payment method used at booking.
7. Liability
Use of the Equipment is at the User’s own risk. The User is at all times responsible for Articles placed in the Equipment. The Operator is not liable for loss or damage resulting from padlock or combination-lock failure, QR code or web-app malfunction, network or connectivity failures, power outages, force majeure, riots, vandalism, weather or outdoor environmental exposure, a combination or QR code accessed by others, theft, or the User’s failure to collect Articles within the rental period. The Operator is not liable for any loss unless willful misconduct or gross negligence on the part of the Operator is demonstrated. Should the Operator be found liable for loss by final legal decision, the Operator’s liability will not exceed $200 per incident.
8. Access Hours
8.1 Smart Lockers
Smart Lockers at a Venue may be accessed only during the Venue’s posted hours of operation. Articles must be collected before the Venue closes or before the end of the applicable rental period, whichever is earlier. The Operator does not guarantee access to the Equipment outside the Venue’s hours of operation, including before opening or after closing, regardless of the rental period purchased.
8.2 Mobile Lockers
Mobile Lockers may be accessed only during the posted hours of the applicable Event, including any posted pre-event opening window and any posted post-event retrieval window. Articles must be collected before the close of the posted retrieval window. The Operator does not guarantee access before the Event opens, after the retrieval window closes, or at any time the Event site is closed to the public for safety, weather, or operational reasons.
9. Mobile Lockers: Outdoor Equipment, Weather, and Event Conditions
Mobile Lockers are located outdoors and are therefore subject to weather and other environmental conditions. The Operator reserves the right, in its discretion or at the direction of Event organizers, public safety officials, or venue/site management, to temporarily suspend access to, relocate, secure, or evacuate Equipment in the event of severe weather, power loss, crowd-safety conditions, or other emergency, without liability to the Operator for any resulting delay in access. Where such a suspension prevents a User from retrieving Articles before the close of the posted retrieval window, the Operator will make commercially reasonable efforts to facilitate retrieval as soon as conditions safely allow, and Articles remaining after those efforts will be handled under Section 10 (Unclaimed Articles). Equipment used at an Event is removed from the Event site at the conclusion of the Event and is not guaranteed to be redeployed at the same or any future Event.
10. Unclaimed and Abandoned Articles
Articles remaining in a locker after the applicable rental period, Event, or posted retrieval window has expired will be considered unclaimed. The Operator or Location may open the locker — including, for a Temporary Mobile Locker, by cutting or otherwise removing the supplied padlock — remove the Articles, and hold them in accordance with the Operator’s lost-and-found procedure and applicable law. Unclaimed Articles will be returned only to a person who can provide proof of identity and proof of booking matching the identity of the User listed on the rental record. The Operator is discharged from all liability toward any person laying claim to Articles in the Operator’s possession once the Operator releases the Articles to a person providing such proof. Articles unclaimed after the period specified in the Operator’s posted lost-and-found policy may be donated, disposed of, or destroyed without further notice or liability to the Operator. For Temporary Mobile Locker rentals, because Equipment is removed from the Event site following the Event, unclaimed Articles will be transferred to the Operator’s designated lost-and-found location, and the User is responsible for contacting the Operator to arrange retrieval.
11. Use of Lockers
The Operator, its personnel, or authorized Location security personnel are entitled to open any locker at any time for safety, security, maintenance, or legal-compliance purposes, including to inspect Articles prior to acceptance into a locker, even where the Articles have been placed in a sealed bag, case, or container. Before use, the User should confirm that the assigned locker is empty, clean, and (for Smart Lockers) functioning correctly, and should report any pre-existing Articles or damage to Operator or Location personnel immediately. Any Articles found in a locker by a User must be surrendered to Operator or Location personnel.
12. Lost or Damaged Equipment Fees
12.1 Mobile Lockers — Lost or Damaged Combination Lock
Where a User loses or misplaces the supplied combination, or where a padlock is lost, broken, or damaged, the Operator will withhold the Articles, and they will be surrendered only once the User has proven entitlement to the Operator’s reasonable satisfaction. If a User loses a supplied padlock, damages or otherwise breaks a lock, or causes significant damage to a Mobile Locker, the Operator reserves the right to charge the User an additional $50.00 to cover replacement and/or repair costs.
12.2 Smart Lockers — Inaccessible Session or Equipment Damage
Where a User is unable to access a Smart Locker rental (e.g., a lost QR code or receipt, or an expired web-app session), the Operator will assist with identity verification and locker release, but is not obligated to release Articles until the User’s entitlement has been established to the Operator’s reasonable satisfaction. If a User damages, tampers with, or causes damage to a Smart Locker (including its electronic locking mechanism, housing, or associated hardware), the Operator reserves the right to charge the User an additional fee, up to $50.00 per incident, to cover replacement or repair costs, plus the cost of any parts or components beyond ordinary wear and tear.
13. Mobile Charging Units
Where a rental at either product includes a supplied mobile charging unit, the User is responsible for returning the charging unit to the locker at the end of the rental period. On loss, breakage, or failure to return a supplied mobile charging unit, the Operator reserves the right to charge the User an additional fee of $25.00 to cover the replacement and/or repair cost of the unit.
14. Smart Lockers: System and Technical Malfunction
In the rare event of a Smart Locker malfunction, network outage, QR code/web-app failure, or power failure that prevents a User from accessing a locker during the rental period, the Operator will make commercially reasonable efforts to restore access or provide an alternate means of retrieving the User’s Articles as promptly as possible. Where such an event prevents access entirely for a material portion of the rental period, the User’s sole remedy is a pro-rated credit or refund for the affected rental, at the Operator’s discretion, and the liability cap in Section 7 continues to apply to any Article loss.
15. Data and Privacy
Booking and paying for a locker rental, for either product, requires the collection of certain personal information, which may include identifying and contact information (name, email, phone number) and payment card information, processed by the Operator’s third-party payment processor. For Smart Locker rentals, use of the web-app additionally involves locker access data (QR code scan and locker activation/release timestamps) and device or browser data (such as web-app session information). The Operator’s Smart Locker product is accessed through a standard web browser rather than a downloaded native mobile app, and does not require the User to create an app-store or app-account profile. Temporary Mobile Locker rentals do not involve any web-app, QR code, or other digital access system — access is by physical padlock and combination only. The Operator does not track or collect User location data for either product, and does not collect biometric identifiers (such as fingerprints or facial geometry) for locker access. If biometric access is offered in the future, it will be subject to separate, specific notice and consent as required under the Illinois Biometric Information Privacy Act (BIPA) and any other applicable law.
This information is used to: operate, secure, and support the locker rental service; process payment; verify identity for the release of Articles under Section 10; prevent fraud and misuse of the Equipment; and comply with legal obligations. The Operator does not sell or share personal information for cross-context behavioral advertising, and does not use personal information for purposes beyond those described in this Section without additional notice.
Depending on the User’s state of residence, the User may have the right to: request access to, or a copy of, the personal information the Operator holds about them; request correction of inaccurate information; request deletion of personal information, subject to legal and operational exceptions (such as records needed to resolve a dispute over lost Articles); and opt out of the sale or sharing of personal information and of targeted advertising, to the extent the Operator engages in either. These rights are provided consistent with applicable U.S. state privacy laws — as of 2026, more than 20 states have enacted comprehensive consumer privacy laws, including California (CCPA/CPRA), Virginia, Colorado, Connecticut, Utah, Texas, Oregon, and others, with additional states’ laws taking effect on a rolling basis. Where required by applicable state law, the Operator will recognize opt-out preference signals, such as the Global Privacy Control (GPC), as a valid method of exercising the opt-out right. The Operator will not discriminate against a User for exercising any of these rights. Requests may be submitted using the contact information in Section 17. A full Privacy Policy describing the Operator’s data practices in greater detail is available on the Operator’s website and is incorporated into these Terms by reference; in the event of a conflict, the Privacy Policy governs data-handling matters not addressed here.
16. Choice of Law
All agreements concluded by the Operator are governed solely by Illinois law. Any dispute in contract, tort, or any other area of the law arising under or in connection with these Terms, or related to any matter which is the subject of these Terms, is subject to the exclusive jurisdiction of the state and/or federal courts located in Chicago, Illinois.
